Terms of Service

These Terms of Service govern your use of Ody Hop's mobile app, website at odyhop.com, and related services. Please read them carefully.

We use "Ody Hop", "we", "us", and "our" to refer to the company operating the service. We use "you" to refer to anyone who uses Ody Hop, whether as a tourist or as an operator.

Acceptance

By creating an account, downloading the Ody Hop mobile app, or using the Ody Hop website, you agree to these Terms of Service. If you do not agree, please do not use the service.

Account types

Ody Hop offers two account types:

  • Tourist accounts: for personal, non-commercial use of the badge collection, leaderboard, and booking features.
  • Operator accounts: for licensed tour guides and tourism businesses participating in the marketplace.
  • Account type is selected at registration and is permanent. Each person or business may hold one account. You are responsible for keeping your credentials secure and for all activity on your account.

The service

Ody Hop is a gamified tourism platform connecting tourists with local experiences and tour operators.

  • Badge claiming requires physical presence at the badge location, verified by GPS, plus a submitted photo.
  • Points, leaderboard rankings, prizes, badge catalogs, and point values are subject to change.
  • We reserve the right to modify, suspend, or discontinue features at any time.

User content

You retain ownership of the photos and other content you submit.

  • By submitting a photo or other content, you grant Ody Hop a worldwide, royalty-free, non-exclusive license to display, reproduce, and distribute that content within the Ody Hop platform (mobile app and website).
  • You represent that you own or have permission to use any content you upload.
  • We may remove content that violates these terms or that we reasonably believe is illegal, infringing, or harmful.

Tour operator marketplace

The marketplace connects tourists with operators. Ody Hop is not a party to the tour or experience contract between them.

  • Operators set their own prices, availability, and cancellation policies.
  • Operators are responsible for delivering the experiences they list and for maintaining required licenses, insurance, and certifications.
  • Ody Hop charges a commission of 15–20% on completed bookings.
  • Ody Hop may suspend or remove operator listings at its discretion, including for quality, safety, or conduct concerns.

Bookings

Bookings made through Ody Hop are between the tourist and the operator.

  • Cancellation, refund, and rescheduling policies are set by individual operators and shown at booking time.
  • Ody Hop is not liable for the quality, safety, or delivery of any tour or experience.
  • Disputes should first be raised with the operator. If they cannot be resolved, you can contact Ody Hop support at support@odyhop.com.

Prohibited conduct

You agree not to:

  • Spoof or fake your GPS location to fraudulently claim badges.
  • Submit photos you did not take or do not have rights to use.
  • Create multiple accounts to manipulate leaderboards, prizes, or rankings.
  • Harass, threaten, or abuse other users, operators, or Ody Hop staff.
  • Use the platform for any illegal activity or in violation of any applicable law.

Prizes and rewards

Prizes are subject to availability and sponsor participation.

  • Ody Hop reserves the right to verify badge claims before awarding prizes or unlocking rewards.
  • Fraudulent claims, including any of the prohibited conduct above, may result in account termination, forfeiture of points, badges, and prizes, and removal from the marketplace.

Limitation of liability

To the fullest extent allowed by law:

  • Ody Hop is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for injuries, losses, or damages arising from tours, experiences, or other services booked through the platform.
  • Our total liability for any claim is limited to the total amount you paid to Ody Hop in the twelve months preceding the claim.
  • We are not responsible for the conduct of operators, tour safety, or the acts or omissions of any third-party service provider.

Termination

Either party can end the relationship:

  • You may delete your account at any time by contacting support@odyhop.com.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the platform or other users.
  • Operators may be removed from the marketplace for quality, conduct, or compliance issues.

Governing law

These Terms are governed by the laws of [jurisdiction TBD]. Any dispute will be resolved in the courts of that jurisdiction.
